影／普悠瑪採購涉放水招標？馬辦：烏龍爆料

由樹林開往台東的6432次普悠瑪列車21日下午於蘇澳新馬車站出軌翻覆，多個車廂變形堆疊，造成18死、187人傷。有立委爆料，當年採購普悠瑪列車時，日本廠商曾拜會時任總統馬英九，涉嫌降低採購規格。馬前總統辦公室今（22）日表示，這是扭曲事實、惡意抹黑意圖帶風向的不實指控。

馬前總統辦公室表示，值此救災時刻，理應全力為傷亡者禱告祈福，為警消人員加油打氣。特定媒體及特定人士在事故調查階段，將一個單純的外交部安排禮貌性拜會行程，扭曲事實、惡意抹黑，意圖帶風向，毫無人性和同理心的作為，令人不齒。

馬前總統辦公室表示，普悠瑪號列車一事，民進黨立委過去已多次烏龍爆料，而外交部及總統府也早已澄清，馬前總統從未針對採購個案指示任何部會，相關會議記錄皆有案可查，這種操作實不可取。呼籲民眾睜大眼睛，看看是那些人士與媒體如此沒有人性，在台灣遭遇重大不幸事故時，還只想著藉機牟取政治利益。

高速路車熄火被撞衝200呎華男重傷

今年67歲的黃先生兩周前駕車前往田納西州，在田納西州內的高速公路上車子忽然熄火，只得打起雙閃等待救援。他後方一輛大卡車發現後雖及時躲避，但大卡車後面的皮卡車卻撞向黃先生的車子，兩輛車分別衝向道路兩側。黃先生當場昏迷，送醫診斷為脊椎、肋骨多處骨折，需手術治療。面對高額的醫藥費，黃先生家人非常擔心如何求償索賠。

黃先生的親屬23日前往曼哈頓華埠美國華人餐飲業協會的法律諮詢求助，表示兩周前黃先生在車納西州高速路上因車子故障等待救援，黃先生車後的大卡車一發現，立即避讓到左側車道。但大卡車後面跟著的一輛皮卡車，卻沒及時避讓，直接向黃先生的車衝撞過去。

巨大的衝擊力將黃先生的車撞到道路右前側200呎，而皮卡車也衝向高速中間隔離帶。黃先生重傷當場昏迷，之後被直升機送往醫院搶救，一天後才甦醒。醫生鑑定黃先生脊椎骨裂、六根肋骨斷裂，日後可能還需進一步手術治療。

律師戴禺指出，黃先生應立即向自己的汽車保險公司申請無過失(No Fault)的5萬元賠償，先支付醫療費。其餘部分可先向黃先生持有的Medicare(聯邦醫療保險)申請賠償。戴禺表示，之所以不先向Medicare索賠，是由於在黃先生的官司打完後，如果獲得對方賠償，則需歸還Medicare支付的賠償金。而無過失險支付的醫療費用則無需歸還。

對於意外傷害賠償，戴禺表示，紐約州意外傷害審判遵循「比例過失」(Comparative Negligence)原則，比如經法院判定對方有25%的責任，黃先生可得到25%的賠償金。雖然田納西州對於意外傷害的審判也遵循「比例過失」賠償，但如果對方車中的責任比例未達50%，黃先生就無法獲得賠償，如果對方責任大於等於50%，黃先生才可按對方責任的比例獲得賠償。
